Terms and Conditions
These rules govern any exam that you take with the Center for Clinician Multilingualism, LLC (CCM). You agree to comply with these rules when you take a CCM exam. If you are taking a CCM exam through an academic institution, then your institution may have additional rules that apply for you taking this exam. Consult with your institution about those rules before taking a CCM exam.
Score. After you complete a CCM exam, you will receive a score of either “Ready” or “Not Ready” for direct language-concordant patient care without a medical interpreter. You may not appeal your score. CCM will provide feedback with your score. If you choose to retake a CCM exam, you may incur an additional charge for a retake, as CCM determines in conjunction with your institution, if applicable.
Confidentiality. By taking a CCM exam, you will have access to information regarding CCM that is not known to the general public (“Confidential Information”), including any exam tasks, questions, answers, computations, diagrams, drawings, worksheets, Materials (as defined below) or other content or exam-related information. You must not, directly or indirectly, distribute, copy, display, publish, summarize, photograph, record, download, transmit or post any Confidential Information. CCM grants you a limited license to use Confidential Information solely for the purpose of taking a CCM exam.
Consent. You consent to CCM taking photographs, videos, and sound recordings in which you appear (collectively, the “Materials”) for use by CCM for education, research, and marketing purposes. You release and forever discharge CCM, its agents, officers, and employees from any and all claims and demands arising out of or in connection with the use of the Materials, including but not limited to, any claims for invasion of privacy or defamation. You agree that all Materials belong to CCM. You may not have a copy of any Materials without CCM’s consent.
Certification. Upon receiving a score of “Ready”, you may publicize that you have successfully achieved the Multilingual Clinician Spanish Certification.
Conduct. In taking a CCM exam, you must conduct yourself in a professional manner and follow any additional rules of the exam setting, either from CCM or a third party.
Payment. You must pay the exam fee prior to taking any CCM exam. If you are taking a CCM exam through an institution, CCM will verify that the institution paid your fee before scheduling your exam. Exam fees are non-refundable.
Rescheduling and Cancelling. You may reschedule or cancel a CCM exam upon providing at least 30 days’ notice. CCM will not charge you an additional cost if you reschedule or cancel with proper notice except for a $150 administrative fee for cancellation. If you reschedule or cancel without proper notice, no refund will be provided. Exceptions (e.g., emergencies) will be considered on a case-by-case basis. If you’re taking a CCM exam through an institution, different terms for rescheduling and cancelling may apply. If CCM must reschedule your exam, it will notify you with reasonable advance notice to arrange a replacement exam time. Your only remedy in case CCM reschedules your exam is a replacement exam time or refund of your exam fee, as CCM determines.
Limitation of Liability. In no event will CCM be liable to you for special, incidental or consequential damages, loss of anticipated savings, wasted expenditure, or for loss of revenue, loss of profits, loss of business opportunity or loss of goodwill even if CCM is aware or has been advised of the possibility of such damages or loss may exist. CCM’s aggregated liability to you for any cause whatsoever, and regardless of the form of action, will always be limited to $1,000.
Indemnity. CCM’s exam and certification are not a replacement for your professional skills and judgment. You must indemnify, defend and hold harmless CCM and its affiliates and their respective managers, officers, agents and assigns, from and against any claims, losses or damages relating to your professional services or any way you hold yourself out to be certified by CCM.
Governing Law and Jurisdiction. These terms and any dispute relating to your CCM exam will be governed by and construed with the laws of the State of Illinois. You agree that the state and federal courts of Cook County, State of Illinois, have exclusive jurisdiction for the purpose of hearing and determining any disputes (including any non-contractual disputes or claims).
Integration. These terms, your pre-exam questionnaire and, if applicable, your institution’s terms contain the sole agreement governing your CCM exam. No other terms apply.
Miscellaneous. Neither these terms nor the CCM certification create an agency, joint venture, partnership or similar relationship between you and CCM.The failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of that right or provision.Any provision of these terms deemed unlawful, void or unenforceable will be severable from the remaining terms and will not affect the validity or enforceability of any remaining terms. No benefits are to be conferred on any third party by these terms.
